Terms of Service for Menace AI

1. Agreement to Terms

These Terms of Service ("Terms," "Terms of Service," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Menace AI ("we," "us," "our," or "Company") concerning your access to and use of the Menace AI mobile application (the "App") available through the Apple App Store.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

2. License Grant and Restrictions

2.1 License

Subject to your compliance with these Terms, Menace AI grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded products that you own or control, strictly in accordance with:

• These Terms of Service
• Apple's Usage Rules set forth in the App Store Terms and Conditions
• Any applicable third-party terms of agreement

This license permits you to use the App solely for your personal, non-commercial use.

2.2 License Restrictions

You may NOT:

• Use the App on any device you do not own or control
• Transfer, redistribute, sublicense, rent, lease, or lend the App to any third party
• Copy, modify, or create derivative works based on the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal, unauthorized, or prohibited purpose
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks
• Attempt to gain unauthorized access to any portion of the App or related systems
• Use the App to create content that violates any laws or infringes third-party rights
• Use automated means (bots, scripts) to access the App or generate content
• Sell, resell, or commercially exploit the App or generated content without authorization
• Use the App to harass, abuse, threaten, or harm others

2.3 Termination of License

Your rights under this license will terminate automatically and immediately without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the App and delete all copies from your devices.

3. Description of Service

Menace AI is a mobile application that enables users to:

• Upload photos from their device or camera
• Generate AI-powered humorous images and short videos
• Access and use credits to create content
• Purchase additional credits through in-app purchases

The App is designed for entertainment purposes and enables users to create and share humorous, meme-style content.

4. Account and Credits

4.1 Free Credits

New users receive 2 free credits upon first-time use of the App. These credits are provided at our sole discretion and are subject to availability.

4.2 Purchasing Credits

Credits can be purchased through Apple's in-app purchase system at the following prices:

• 10 credits - $1.99 USD
• 40 credits - $4.99 USD
• 100 credits - $9.99 USD

Prices are in U.S. dollars and may vary by region. All purchases are processed through Apple's payment system and are subject to Apple's payment terms.

4.3 Credit Terms

• Credits are digital consumables used within the App to generate content
• Each content generation request consumes credits based on the complexity and type
• Credits do not expire but have no cash value
• Credits are non-refundable except as required by applicable law or Apple's refund policies
• Credits are tied to your device and cannot be transferred to other users
• We reserve the right to adjust credit pricing with reasonable notice
• Credit balances cannot be redeemed for cash or exchanged for real-world goods

4.4 In-App Purchases and Refunds

All purchases are final and processed through Apple's in-app purchase system. For refund requests, you must contact Apple directly through their refund request process. We do not control Apple's refund policies or decisions.

In the event of a refund approved by Apple, we reserve the right to:

• Deduct the refunded credits from your balance
• Restrict or suspend access if refund abuse is detected
• Take appropriate action to prevent fraud

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of any photos you upload to the App ("User Content"). By uploading User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

• Process your photos to generate AI content
• Store photos temporarily for processing purposes
• Use anonymized, aggregated data for service improvement

We will not use your photos for any other purpose without your explicit consent.

5.2 Generated Content

Content generated by the App using AI ("Generated Content") is created based on your uploaded photos and prompts. You receive a non-exclusive license to use Generated Content for personal, non-commercial purposes, subject to:

• Not using Generated Content in ways that violate laws or third-party rights
• Not claiming the Generated Content infringes on anyone else's rights without basis
• Understanding that AI-generated content may have limitations on copyright protectability

5.3 Our Intellectual Property

The App, including its design, features, functionality, source code, algorithms, and all related intellectual property, is owned by Menace AI and protected by copyright, trademark, and other intellectual property laws.

5.4 Third-Party Content and Rights

You are solely responsible for ensuring you have the right to upload and process any photos you submit to the App. You must not upload:

• Photos containing individuals without their consent (where applicable)
• Copyrighted images you don't have rights to use
• Content depicting illegal activities
• Content that violates any person's privacy or publicity rights

6. AI Processing and Third-Party Services

The App uses third-party artificial intelligence services to process your photos and generate content. By using the App, you acknowledge and agree that:

• Your uploaded photos will be transmitted to and processed by third-party AI service providers
• These AI services are necessary for the core functionality of the App
• We select reputable AI providers with appropriate security and privacy practices
• Processing may involve temporary storage of your images by AI providers
• We are not responsible for the actions or practices of third-party AI providers beyond our contractual arrangements
• You must comply with any third-party AI provider terms that apply to the generated content

7. Acceptable Use and Content Standards

7.1 Prohibited Content

You may not create, upload, or generate content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful
• Contains nudity, sexual content, or pornographic material
• Promotes violence, terrorism, or harm to minors
• Infringes on intellectual property rights or privacy rights
• Contains malware, viruses, or harmful code
• Impersonates others or misrepresents your affiliation
• Violates any applicable local, state, national, or international law

7.2 Content Moderation

While the App is designed for humorous content, we reserve the right to:

• Monitor content created through the App
• Remove content that violates these Terms
• Suspend or terminate accounts that repeatedly violate content standards
• Report illegal content to appropriate authorities
• Implement content filtering or moderation systems

7.3 User Responsibility

You are solely responsible for:

• All content you upload and generate through the App
• Ensuring you have necessary rights and permissions for uploaded content
• Any consequences resulting from your use of Generated Content
• Complying with applicable laws in your jurisdiction

• Apple is not responsible for any intellectual property infringement claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms
