MENACE AI — TERMS OF SERVICE

1. Agreement to Terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "User") and Menace AI ("we," "us," "our") governing your use of the Menace AI mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not download or use the App.

2. License

We grant you a limited, revocable, non-exclusive, non-transferable license to use the App on Apple-branded devices you own or control, subject to:

• These Terms
• Apple's App Store Terms
• All applicable laws

You may not:

• Copy or modify the App
• Reverse engineer or extract source code
• Rent, lease, sublicense, or resell the App
• Interfere with the App's servers
• Use the App to violate laws or third-party rights
• Use bots or automated scripts
• Generate harmful, illegal, or abusive content

Your license terminates automatically if you violate any provision.

3. Description of Service

Menace AI allows users to:

• Upload photos
• Generate AI-powered images and videos
• Use credits to generate content
• Purchase subscriptions or additional credits

Menace AI is an entertainment service that produces humorous, meme-style content using third-party artificial intelligence models.

4. Account, Subscription, & Credits

4.1 Subscriptions

Users may subscribe to weekly or monthly plans that provide credits for use during the subscription period.

Subscriptions:

• Auto-renew until canceled
• Are billed through Apple
• Cannot be refunded by Menace AI

Cancel anytime via Apple ID settings.

4.2 Credits

• Image generation = 10 credits
• Video generation = 100 credits
• Credits have no cash value
• Credits are non-transferable
• Credits may be purchased as in-app purchases
• Refund requests must be submitted to Apple
• If Apple grants a refund, Menace AI may revoke associated credits

You acknowledge that credits are consumed even if output is imperfect, as AI model results may vary.

5. User Content & Rights

5.1 Your Content

You retain ownership of photos you upload.

By submitting content, you grant Menace AI a limited license to:

• Process and transmit the content
• Use it temporarily to generate AI output
• Improve service performance in anonymized form

We do not train AI models on user images.

You represent that you have all necessary rights to upload the content.

5.2 Generated Content

You receive a non-exclusive license to use generated content for personal use, subject to:

• No unlawful use
• No impersonation of real individuals
• No defamatory, erotic, political, or harmful usage

AI-generated content may be subject to limitations under copyright law and may not be protectable.

6. AI Processing & Third-Party Providers

Menace AI uses third-party AI processors, including but not limited to:

• Nano Banana (image generation)
• Kling 2.5 Turbo (image-to-video generation)

By using the App, you consent to having your uploaded photos processed by these models.

You acknowledge:

• Your content may be temporarily stored by third-party AI processors
• Menace AI does not control their internal model behavior
• AI outputs may contain artifacts or unintended content
• AI systems may generate inaccurate or unpredictable results

Menace AI is not liable for actions taken by external AI processors.

7. Biometric & Facial Data Disclaimer

Menace AI:

• Does NOT collect biometric identifiers
• Does NOT perform facial recognition
• Does NOT extract faceprints or templates
• Does NOT use photos to identify individuals
• Does NOT train models on user images

All facial information is processed transiently and deleted after generation completion. This protects you under BIPA, CPRA, Washington MPA, and similar laws.

8. Prohibited Uses (Deepfakes, Harassment, Illegal Content)

You may NOT upload or generate:

• Non-consensual sexual imagery
• Realistic political deepfakes
• Harassment, bullying, or abuse
• Depictions of minors in unsafe contexts
• Content meant to impersonate or defraud
• Disinformation or election-related material
• Copyright-infringing uploads

Menace AI may suspend or terminate accounts that violate these rules.

9. Indemnification

You agree to indemnify, defend, and hold harmless Menace AI from all claims arising from:

• Your uploaded content
• Your AI-generated content
• Your misuse of the App
• Any violation of laws or rights of others

You bear full responsibility for third-party claims arising from your usage.

Apple is not responsible for:

• Support
• Warranty claims

Apple may enforce these Terms as a third-party beneficiary.

These Terms are governed by the laws of the State of California, USA.
